HB 943 – Real Property and Land Use and Development

What it does: Preempts local zoning rules, forces cities and counties to allow multifamily and mixed-use housing regardless of local planning, and blocks local governments from imposing meaningful design, density, or infrastructure standards.


Why it’s bad for Home Rule:

  • Destroys local zoning authority by forcing one-size-fits-all development mandates on every community.
  • Prohibits local governments from negotiating with developers on density, height, or impact mitigation.
  • Prevents communities from protecting neighborhood character, infrastructure capacity, or environmental concerns.
  • Shields developers from local accountability and turns community planning into a rubber stamp process.

SB 184 & HB 247 – Affordable Housing / Accessory Dwelling Units (ADUs)

What they do: Require all local governments to allow accessory dwelling units (ADUs) in single-family neighborhoods and incentivize density bonuses without meaningful local input or impact analysis.


Why they’re bad for Home Rule:

  • Mandate local zoning changes without local consent — stripping away the right of cities and counties to plan neighborhoods responsibly.
  • Use the language of affordability to override local control, while failing to guarantee that these ADUs or bonus units will actually be affordable.
  • Undermine neighborhood planning and infrastructure balance, bypassing conversations with residents and local leaders.

SB 1128 & HB 1035 – Building Permits for Single-Family Dwellings

What they do: Force local governments to approve building permits within two days based solely on private engineer or architect sign-off, particularly in areas affected by declared emergencies.


Why they’re bad for Home Rule:

  • Eliminate local oversight in the permitting process, removing community safeguards and checks.
  • Create a dangerous precedent where developers can bypass local review by hiring private sign-offs.
  • Open the door to code violations, safety issues, and infrastructure strain, especially post-disaster when communities are already vulnerable.

These Bills Undermine Home Rule & Local Governance

Local problems require local solutions. These bills strip away the right of communities to shape their future and put developers in the driver’s seat.
